In a significant ruling dated 28 July 2025, the Family Court of Nicosia (child maintenance jurisdiction) dismissed the mother’s claim for total maintenance of €1,200 per month for her two minor children.
Our firm represented the father at the written witness stage and in final submissions. The Court fully adopted our argument that, since the children overnight with the father half the week, and under the relevant case law, the father is not obliged to pay any amounts relating to the children’s basic needs — food, clothing/footwear, water, electricity and generally the ordinary daily costs of accommodation and care.
As to other expenses, such as education and activities, the Court ordered proportional sharing according to the parents’ incomes: the mother will cover those expenses and produce receipts, and the father must reimburse 42% of the amounts paid.
Further, noting that on 27 April 2023 an agreed interim order required payments of €650 per month, the Court examined the financial records and found that our client had paid approximately €10,000 more than he was obliged to pay. The Court therefore ordered a set‑off, directing that €200 per month be deducted from future payments until the overpayment is fully recovered.
